Terms of Service for Private Commissions

general Terms

Prices are subject to change based on demand.

I have the right to refuse any order for any reason.

Orders can only be paid through PayPal.

Orders can be paid 100% in advance or divided into 50% in advance and 50% after approval of the sketch.

Do not send me any payment until I have agreed to give you a slot and requested you to send me the payment.

PROCESS
& DELIVERY

The time required to complete your order varies from 1 week to 3 depending on factors such as health, the complexity of the commission, and other work in progress.

Once the drawing is completed, you will receive the full resolution image with a web-friendly size. Note that there is no physical product.

CORRECTION
-
A fee will be added if you want to change anything on the final drawing, when it's completed - unless there has been some misunderstanding on my part.

If you wish for me to change something in the drawing you previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

If your references are unclear to start with, changes will come as extra charge.

COPYRIGHT
& USage
I, Amélie Dadiès (the illustrator):

I reserve the right to cancel and refund the order at any time for any reason.

I retain all copyrights on the commissioned work.

I will NOT claim intellectual property (IP) for the ordered drawing.

I will NOT profit further from the commissioned drawing unless you (the customer) break any of the terms.

I reserve the right to put the ordered drawing online, in my portfolio as well as in publications such as art books.
You (the client / sponsors):

You may upload the ordered drawing from any website and social channels.
-
You may NOT make profits from the ordered design (reselling, redistributing, upload to POD services, making prints, etc.)

You may NOT alter the commissioned drawing without my consent.

You retain the rights to intellectual property (IP).

You may NOT use the commissioned design for commercial purposes.
The following is considered a copyright infringement:
- Reproducing / using the copyrighted works for commercial purposes - meaning to earn money in any way not excluded from these terms.
- Claiming the work as yours
- Altering the drawing without my consent

In some cases, the commercial rights to the image may be purchased.

cancellation
& refund policy

The buyer is not entitled to a refund once I have started working on the order.

If for some reason I am unable to start your commission, you will receive a full refund.

If you cancel your order before I have started it, you may get a full refund.

If you get a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
What do you get?

Drafts / sketches from which you decide which one I should continue with (depending on the complexity of the commission, there may be more or less drafts.)

Final sketches and / or sketches that you must accept before I continue with the work

Involvement in the choice of colors (depending on the complexity of the commissioned drawing)

Full resolution file of the final drawing and a smaller version for internet download. The format of the final file is usually PNG.
